Administering the Contract
You've won the contract! Now, you must perform the work or deliver the product, and we can help you administer the contract. We can prepare the work or deliver the product and negotiate subcontracts and purchase orders with your team members. We will work with you on small business issues, including subcontracting plans, "8(a)" applications, and business plans.
We can help you develop systems and policies for purchasing and contract management and training for your employees. We will help you when contract interpretation issues arise and when contract modifications are needed.
If the project goes awry, we will prepare and submit claims for equitable adjustment to recover additional costs incurred.
Compliance Plans and Training
The government will insist on strict compliance with the terms and conditions of the contract as well as any regulations or statutes. A code of conduct may be required and operations reviews should be conducted. If you export products or services, export regulations must be adhered to. The consequencces of non-compliance may be severe.
Completing the Contract
When the contract is physically complete, we will handle the closeout procedures and help settle outstanding cost reimbursable items. If, however, the contract is terminated for the convenience of the Government, we will prepare a termination settlement proposal.
We also provide employment and labor relations assistance as well as intellectual property support as described below. If you receive Government Furnished Property (GFP), then you must inventory, and be responsible for these tangible assets. We can perform the inventory and maintain the property records and continuing inventory.
Terminations of Government Contracts
The government has broad rights to unilaterally terminate its contracts. Although relatively rare, the risk is real, particularly with reductions in spending, so be prepared. A contract may be terminated for convenience (or default) in whole or in part for which the government must pay fair compensation to include allowable cost, a reasonable profit, and settlement costs. Nevertheless, terminations completely disrupt the contractor’s business base and can result in loss of jobs. CUI can help you obtain the compensation you are entitled to in a termination for convenience.
Disputes in Government Contracts
The government should be a reliable contract partner dependable for fulfilling its contractual obligations. It is a fact of life that reasonable people will disagree resulting in a dispute. We prefer to avoid misrepresentations by negotiating a reasonable solution. If all else fails, CUI can prepare and submit a request for equitable adjustment or a claim to the government. No customer or agency wants a dispute. Under government cost cutting, disputes may be unavoidable. CUI can assist clients to obtain reasonable compensation from a dispute.
